Use of Site
LocalCarBids.com (LOCALCB) authorizes the use of this Website (SITE) in agreement with these Terms of Use (TERMS). You REGISTRANT must read, agree with and accept all of the terms and conditions contained in this Agreement before you become a member of the site. If you do not agree to be bound by the terms and conditions of this Agreement, do not use or access our services.

Registering
All REGISTRANTS must register before bidding. Registration is free to REGISTRANTS. By registering you agree that you are providing accurate information about yourself. You further authorize that at the end of an auction in which you are a winner, name, email address and phone number will be supplied to the seller so that they may contact REGISTRANT. You also authorize the sending of an email to you notifying you of the dealer information when you are the high bidder in a completed auction.

Bidding
By placing a bid REGISTRANT is entering into a legal contract with the selling party and you agree to follow through with your purchase, including any and all costs, if you are the winner of the auction in accordance with the terms of sale for that auction. All winners will be notified via email. Winning bidders will be notified of the total purchase cost by e-mail within 24 hours of the closing of the auction. You must be 18 years of age or older in order to bid or be supervised by a parent or guardian who will be involved in the transaction.

Right to Suspend Use of SITE
LOCALCB reserves the right to refuse service to any REGISTRANT at any time. If any of the TERMS are violated, LOCALCB reserves the right, at LOCALCB's discretion, to suspend use of the SITE but LOCALCB is not limited to this action. LOCALCB will take whatever legal steps are necessary to enact such suspension. LOCALCB reserves the right to postpone, delay, interrupt or cancel an auction for any reason.

LOCALCB is just an Internet Location
Although the word 'auction' is used on our name, LOCALCB is solely an internet location where sellers are able to list their vehicles for sale and consumers are able to bid on those vehicles. LOCALCB is not acting as an auctioneer.

Internet Outages, Accuracy, Loss of Data and That Which is out of LOCALCB's Control
Although every step is taken to ensure that LOCALCB is always online and that the information contained on its site is accurate, LOCALCB is not responsible for damage or loss caused by errors in the system or the Internet or anything related to Internet outages, loss of integrity or accuracy of data, lost data or anything else that is in the control of LOCALCB or out of the control of LOCALCB. This includes but is not limited to lost data, mathematical errors, Internet outages.

Resolution of Auction Disputes
In the case of a dispute that is caused by any error, technical or otherwise, such as high bidder, high bid, current bid, a case will be made to LOCALCB by the parties involved via email or the contact us section of the website. LOCALCB will review the error within 48 hours and make a decision. All decisions by LOCALCB are final.

Manual Database Alterations
LOCALCB reserves the right, in resolution of disputes or for any other reason, to manually go into the database of auctions and edit any of the fields that are required to be updated.

Privacy Policy
REGISTRANT information will not be sold, leased or provided in any way to any third party. You will only receive emails from LOCALCB or a seller unless you opt-in to receive such emails except when you are the winner of an auction in which you will receive an email notifying you that you are the winner and the contact information of the seller so that you can contact them. Upon winning an auction, REGISTRANT'S name, phone number and email address will be provided to the seller so that they can contact you.

Changes or Amendments to the Terms of Use
LOCALCB can amend any part of this agreement without prior notification to REGISTRANT. Changes will be effective 14 days after the changes are posted on the SITE. This agreement is effective for all users on, September 15, 2003.

Disclaimer of Warranty
LOCALCB, AND SITE PROVIDE OUR WEBSITE AND SERVICES "AS IS" AND WITHOUT WARRANTY AND MAKE NO EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, ANY EXPRESS OR IMPLIED WARRANTY OF TITLE, MERCHANTABILITY, ACCURACY OF INFORMATIONAL CONTENT, FITNESS FOR PARTICULAR PURPOSE OR SYSTEM INTEGRATION OR AGAINST NONINFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS.

Disclaimer of Liability
IN NO EVENT SHALL LOCALCB SITE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).

Release
In the event REGISTRANT has a dispute with one or more DEALERS, USER agrees to release and hold harmless LOCALCB and SITE from all claims, demands, damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Indemnity
REGISTRANT agrees to indemnify and hold LOCALCB and SITE, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party. REGISTRANT further agree to indemnify and hold LOCALCB and SITE, harmless with regard to loss or damage experienced through the use of this system.

Legal Compliance
REGISTRANT shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding use of our service and bidding on, listing, purchase, solicitation of offers to purchase, and sale of vehicles.

DEALER/REGISTRANT shall comply with all applicable domestic and international laws, statutes, ordinances and regulation regarding the use of SITE, listing, purchasing, bidding on and sale of vehicles.
